The IRS ceases collection attempts while an offer in compromise is in review. Does the California Franchise Tax Board do the same? Can I stop making payments while the OIC is being reviewed?|||Hello Hiro,
What you need to understand is that the offer in compromise application does not guarantee that it must be approved. You should continue to make payments until the collector from your county make first contact and advisies you that you can stop payment. If the CA FTB is after you, they will stay after you for a long, long time. You may not cease payments to any collections from the FTB, while handling a settlement issue with the IRS, unless you somehow got yourself some sort of stay from the FTB, which isn't too likely.
Furthermore, with the FTB, i believe, even if you declare bankruptcy, for your corporation, the FTB still holds the agent of records personally liable for any debts with the FTB.
